Can I use Suno songs commercially?

Yes, if you made the song while on a paid Suno plan (Pro or Premier) and downloaded it from Suno. Songs made on the free plan are for personal, non-commercial use only, and upgrading later does not change that. Songs made by other people are theirs: downloading one gives you no right to reuse it.

The short version: what you can do with a Suno song depends on who made it and which plan they were on when they made it. How you downloaded it does not change either of those.

Rights by plan

Song made on Personal use Commercial use Download from Suno
Free plan Yes No Trial downloads only
Pro Yes Yes 20 a month
Premier Yes Yes 60 a month
Someone else’s account Listening only Only with their permission Not possible

Commercial use means anything that earns money or promotes something: streaming releases, monetised videos, ads, podcasts with sponsors, client work, games and apps you sell.

Songs you made on a paid plan

Suno’s terms let you use songs made while subscribed to Pro or Premier commercially, including after you cancel. To release one:

  1. Download the song from Suno as WAV (this uses one of your monthly downloads; see the Suno download limit).
  2. Upload it through a distributor. Read their policy on AI-generated music first; some ask you to label it.
  3. Keep a record of the date you made the song and your plan at the time, in case anyone asks.

Songs you made on the free plan

They are for personal listening and sharing, not for money. Upgrading later does not turn them into commercial songs. If you love one, recreate it on a paid plan and release that version.

Songs made by someone else

A public Suno song still belongs to the person who made it. You can listen to it, share its link and save a copy for yourself with a tool like the Suno song downloader. You cannot put it in your own release, video or product unless the creator says yes, and for commercial use they would need to have made it on a paid plan too.

Can AI music be copyrighted?

In the United States, the Copyright Office has said that material generated entirely by AI is not protected by copyright, while human authorship (lyrics you wrote, edits and arrangements you made) can be. That means a fully AI-generated track may be hard to protect against copying, even when Suno’s terms let you use it commercially. Other countries treat this differently, and the law is still moving.

A checklist before you release a Suno song

  • You made the song yourself, on Pro or Premier.
  • You downloaded the WAV from your own Suno account.
  • Your distributor accepts AI-generated music, and you labelled it if they ask.
  • Any lyrics or samples you added are yours or licensed.
  • You have read Suno’s current terms, because they change.

FAQ

Questions people ask

Can I upload Suno songs to Spotify?

Songs you made on a paid Suno plan can be released through a distributor such as DistroKid. Upload the WAV you downloaded from Suno, and check your distributor’s own rules on AI-generated music before you submit.

Can I monetise a YouTube video that uses a Suno song?

If you made the song on Pro or Premier, Suno’s terms allow commercial use, which includes monetised videos. Songs from the free plan or from other creators are not covered.

If I upgrade to Pro, can I sell songs I made on the free plan?

No. Suno ties commercial rights to the plan you were on when you made the song. Songs from your free-plan days stay non-commercial; remake them on the paid plan if you want to release them.

Can I copyright a Suno song?

Partly, at most. The US Copyright Office says material generated entirely by AI is not protected, while human contributions such as lyrics you wrote yourself can be. Rules differ by country, so ask a lawyer for anything important.

Can I use a Suno song I downloaded with a third-party downloader?

Only in the same ways you could use it anyway. A downloader saves a copy for listening. If the song is not yours, ask the creator. If it is yours, download it from Suno on a paid plan for any commercial use.

Is this legal advice?

No. This is a plain summary of Suno’s published terms as of October 2026. Read Suno’s current terms, and talk to a lawyer before a release or a client deal.
